Terms and conditions of use

Please read carefully the following Terms and Conditions and if you do not agree with them, please do not order any product.

By placing an order via our online boutique, or via email, you agree to sign a contract with our company under the present conditions This is why it is very important, that you read and understand all of this terms and you accept them before placing any order.

All products presented on our online boutique Baccarada.com, are owned by Lidia Bersani, and are sold directly by Lidia Bersani, registered in Monte Carlo, 2 Rue Honore Labande, 98000 Principaute de Monaco, business register number 12PO7913, TVA no. FR71000096858.

All products on our online boutique www.Baccarada.com, designs, patterns, products, pictures, etc. are owned by Lidia Bersani and are protected by copyright. All copyrights, trademarks and all other intellectual property rights in all material or content within this online boutique shall remain at all times the property of LIDIA BERSANI.

 1. Our Products:

All products we offer on our online boutique are for decoration of luxurious interiors houses, apartments and villas. Our products are made in Italy, some of our products are bespoke and handmade, made to order. Some products are made by our partners in Italy and other countries. Some of our collections are made in only a few pieces, this is the reason why some of them can be available only for a limited time.

Each product showed on our online boutique comes with a description and pictures.
Please remember that the color you can see can be slightly different from the original. This may depend on the settings of your computer monitors shading and the color may therefore appear different from the exact color.
This is why we recommend you to order first some sample of the fabric to be sure that the color and the kind of fabric is exactly the one you want to order. After placing you order, we are not responsible for any differences. 

2.  Measurements 

Many of the goods we sell are made to measure, according to measurement you provide (curtains, bedcovers, tablecloths, carpets, furniture, etc.). It is your responsibility to take the correct measurements of the products you order. If you cannot find the size that suits your requirements, please contact us via email at boutique@baccarda.com for more information.
If you are unsure about any product or how to measure please contact us for assistance before ordering.
Be careful of checking the product details and measurements before placing your order online and make sure to check the order confirmation sent to you via the email, as you will be responsible for that.
If the products will need corrections because of incorrect dimensions you provided, we will do our best to correct them but at an additional charge.

3. Made to measure products

Made to measure products are custom made to your precise requirements. Once made, our products are only suitable to you and therefore your order cannot be canceled or returned.
This condition applies for ordered products as per below:
-  Goods which are presented in our catalog in standard sizes and finishing but which need to be especially made for you upon request.
- Custom made products, made according to your particular requirements, dimensions or finishing.
After placing your order you will have 24 hours to check everything and make sure that your order is correct. During this period of time you will be able to cancel your order if necessary and without any consequences. After 24 hours we will start the preparation of the ordered products, this is the reason why the cancelation or change of part or full order will not possible.
Because of this it is extremely important that you are sure about the product that you want to order as well as the size you require. We strongly advise that you take advantage of our sample before placing an order, we cannot be held responsible if you dislike the color or the general quality of the product. We strongly recommend that you double check your order to ensure that the products ordered and measurements taken are correct. This does not affect your statutory rights. 

4. Fabrics

The process of production of fabrics, is such that we cannot confirm for each order an exact identical shade. This is why we cannot guarantee that your next order will have 100% identical shades of colors as your previous order.
This is why we recommend you to order all products which you want to keep in one room within the same order, for example curtains, cushions, etc.

5. Natural fur

Please note that all our natural products, like fur, feathers, leather, are not produced in a factory, but are made by nature. We dye them, but nature has it that they can have slightly different color shades, appearance, size or length of hair, etc. Each piece can be slightly different, this is what make them more beautiful and more natural.

Order processing and our contract:

 1. Order cancellation or amendments

You can return your purchases within 14 days of the delivery date. Returned products must be complete, in good condition, without signs of use and in their original package.
To exercise the right of withdrawal, you must inform us of your decision to terminate the contract. To this end, a statement must be submitted (for example, a letter sent by email).
 
WARNING! Only standard products can be returned. Items produced on individual orders, like for example furniture, carpets, curtains, tablecloths make to order cannot be returned. Therefore, if you choose the individual order option, consider before submitting the order whether you have chosen the right colour, model, size and quantity. But you still have 24 hours to cancel your order.

After 24 hours from placing your order the cancellation rights do not apply. After this lapse of time you will not be able to cancel your order. This will not affect your legal rights as a consumer in relation to made-to-measure goods that are faulty or not as described.

In the event of termination of the contract and return of your order (only standard goods) we will reimburse you in full.

The refund is made with the same method of payment you chose for the initial transaction, except in cases where you have agreed to other solutions.
You will have to bear the direct costs of returning the items.

2.      Prices

The price you will pay is the price shown at the checkout and on your confirmation email, these prices are inclusive of VAT and the total price shown is the price you will pay.
The prices on the online boutique are subject to change. However after placing the order, the valid price will not be changed.
Delivery cost will be at extra charge.
On receipt of your confirmation email check to ensure you are completely happy with the price of the goods ordered. 
If the goods are sent to a country outside the EU, extra charges and duties may apply according to the rules of the country and cost of delivery to your address.

3.    Payment

When ordering products from our online boutique we can only process your order when the goods ordered have been paid for in full by credit or debit card. You can pay on-line with all major credit and debit cards. Your payment card details will be encrypted to minimize the possibility of unauthorized access or disclosure.

Authority for payment must be given at the time of order. You will be charged for items at the point of order. Our liability to you in connection with any order will not exceed the total price charged for the relevant items. We accept internet orders only from web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, 3.0 version or higher of Explorer and versions 3.02 or higher of Netscape. This means you cannot inadvertently place an order through an unsecured connection.

We can accept as well directly transfer of payment to our account. You will then receive confirmation of your order via email, with all details of the payment. In this case, the order will start to be processed after we have received the full amount of the order into our account. The payment will have to be done within 7 days of placing the order, after which the order will be cancelled.

4.    Acceptance

We have the right to cancel your order if:

a) We have insufficient stock to make and deliver the goods ordered.
b) You have ordered from a country where we cannot deliver
c) The goods ordered have been discontinued
d) A pricing error or typing error has occurred due to system failure within our database or website.
If for any reason beyond our reasonable control, we are unable to supply a particular item, we will notify you as soon as possible. No discount or compensation can be offered under these unforeseen circumstances.

Processing and Delivery of your goods

1.      Some of our products are handmade, made to measure, this is why sometimes processing time can be long. Processing time is marked next to each product. This is the time necessary to produce for you the products. This does not include the delivery time required.
2.      Some of our products are available from our stock, in which case it is possible to deliver in shorter time.
3.      We will inform you about readiness of the good for delivery via email.
4.      The goods will be dispatched via courier.
The shipping time depends on your country and your choice of standard or express delivery. We are not responsible for late delivery due to the courier. All shipments we sent will be insured, but we cannot be held responsible for the goods during delivery.

Defective and damaged good

All our products are rigorously quality checked before dispatch but in the unlikely event that you experience any problem please e-mail us at boutique@Baccarda.com.
You have 3 days following the receipt of your goods to report any damaged or defective goods due to manufacturing, or damage caused while being in the delivery process. We will deal with your queries promptly and if necessary, arrange for a replacement. We reserve the right to ask for digital pictures with regards to the issues reported or to ask for the product to be returned to us for inspection. This does not affect your statutory rights. 
Please carefully check the condition of the goods in the presence of the courier. If you will notice any damage caused during delivery, you will have to fill out a special form with the courier, as this kind of damage is the responsibility of the courier. We cannot help you with this kind of damage.

1.      Guarantee

We will offer a 12-month manufacturers’ guarantee on manufacturing faults. We reserve the right to either replace or repair the product and it may be necessary to return the goods to us for inspection prior to a replacement product being dispatched. This does not affect your statutory rights.
We are not responsible for any damages to the goods.
Please be careful of using properly the goods and please carefully check the cleaning instructions. You can ask at any time for our advice.

2.      After Sales Service

We can offer you our services regarding cleaning, installing, advising, repairing, etc.
The service we can offer you naturally depends on your location.

We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service. We will not e-mail you in the future unless you have given us your consent. We will never pass your details on to any third party without your express permission. We will give you the chance to refuse any marketing email from us in the future.

The type of information we will collect about you includes:
- your name
- address
- phone number
- email address
- credit/debit card details

We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracy we will delete or correct it promptly.
The personal information which we hold will be held securely in accordance with our internal security policy and the law. If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first.

We may use technology to track the patterns of behavior of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings. Law and Jurisdiction

These Product Terms and Conditions willl be governed by and construed in accordance with the Monaco law, and any disputes relating to the same will be subject to the exclusive jurisdiction of the court of Monaco. If any of these Product Terms and Condition is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
